0:00 Sixty-three percent of the exoneration cases handled by the New York Innocence Project involve a false confession.0:08 That’s not a typo.0:10 In nearly two-thirds of cases where the system admits it got the wrong person, the conviction was built on the person’s OWN words.0:19 Last week, we saw how a mistaken eyewitness, someone completely separate from the crime, could build a case against an innocent man.0:29 This week, we look at something even more unsettling: when the state’s star witness… is the defendant herself.0:38 This is the story of a woman named Jasmine.0:41 It began the way these stories so often do—with a family tragedy.0:46 A terrible accident, and her young daughter grievously injured.0:51 In the fog of grief and panic, Jasmine was taken to an interrogation room.0:56 And for four hours, detectives told her she had done it.1:00 They told her she had violently shaken her daughter, and that if she just admitted it—if she just confessed—she could go see her child in the hospital.1:12 They made her demonstrate the shaking on a doll, over and over, while she sobbed and denied it.1:19 After four hours… she broke.1:21 She told them what they wanted to hear.1:24 This case has always reminded me of another.1:28 The Central Park Five.1:29 You remember the story.1:31 Five teenagers, interrogated for hours, separately.1:35 Police lied to them, telling each one that the others had confessed.1:40 They promised them that if they just signed the papers, they could go home.1:46 It’s the same pattern.1:47 You find a person at their most vulnerable, you isolate them, you exhaust them, and you offer them a single, false key to a locked door.1:58 The analogy holds because the mechanism is identical: confession as a product of coercion, not conscience.2:06 The only thing that’s different this time is that it wasn't five boys in a media firestorm.2:12 It was one terrified mother, alone in a quiet room.2:16 And her confession became the entire case.2:20 So, what does it all add up to?2:22 The prosecution had what it needed.2:25 A signed statement.2:26 A videotaped confession.2:28 To a jury, that is the most powerful evidence imaginable.2:32 It answers the question that hangs in the back of everyone’s mind—the one Robin Dahlberg, a lawyer who has studied these cases for years, put so bluntly: “If you don’t commit a crime, why the hell would you admit that you did?” It seems impossible.2:51 Unthinkable.2:52 And so, when Jasmine’s defense attorneys tried to bring in an expert to explain the psychology of false confessions… to explain how fear and exhaustion and manipulation can make an innocent person say ANYTHING… the judge refused.3:09 The court denied the request.3:11 The jury was never allowed to hear that this phenomenon is real, that it's studied, and that it happens all the time.3:20 That was the moment.3:22 The moment the path was set.3:24 The system decided that a jury’s intuition was more reliable than decades of scientific research.3:31 It decided that the confession, on its own, was enough.3:35 No expert testimony.3:37 No context.3:38 Just the words spoken under duress.3:40 And so she was convicted.3:42 Years passed.3:43 Years she lost, while her daughter grew up without her.3:47 The exoneration, when it finally came, was the result of a long, slow, grinding effort by people who looked at that four-hour interrogation tape and saw not a confession, but a crime.4:01 They saw the systemic failure that the Innocence Project data proves is not an anomaly.4:08 It's a feature.4:09 A disproportionate number of those exonerated are Black, like Jasmine, losing more years of their lives than anyone else.4:18 Because the system is more willing to believe their guilt, even when the words are forced from their own mouths.4:27 This week sets up the truth we have to confront next.4:31 A confession is not always the end of a crime’s story.4:35 Sometimes, it’s the beginning of one.
